Torusify Terms, EULA, and Refund Policy

The English version of these Terms is the controlling version. The Japanese version is provided for convenience.

These Terms apply to Torusify, a macOS app for multi-display cursor movement, and the Rhamosia / Torusify website. Torusify is operated by Rhamosia Inc. under the Rhamosia brand.

If you do not agree to these Terms, do not use Torusify or the website.

Provider Terms and Order of Terms

Your use of Torusify may also be subject to the terms, usage rules, refund rules, subscription rules, payment terms, licensing terms, and platform policies of the provider through which you obtain or use Torusify.

These providers may include app stores, payment processors, subscription platforms, licensing providers, marketplace operators, and related developer tools.

For the Mac App Store version, your use of Torusify is subject to Apple’s App Store terms, Apple Media Services terms, and the Apple Standard EULA unless Rhamosia provides a custom EULA through App Store Connect.

When Torusify is obtained, purchased, licensed, subscribed to, or accessed through a provider, that provider’s checkout, refund, subscription, license, and account terms may apply in addition to these Terms. If provider terms conflict with these Terms for provider-managed payment, refund, billing, subscription, license, account, or platform access matters, the provider terms control for those provider-managed matters.

Nothing in these Terms limits rights that cannot be limited under applicable law.

License

Subject to these Terms and any applicable provider terms, Rhamosia grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Torusify for your personal or internal business use on compatible Apple-branded macOS devices that you own or control, or as otherwise permitted by the provider’s usage rules.

Torusify is licensed, not sold. Rhamosia and its licensors retain all rights not expressly granted to you.

You may not:

• copy, redistribute, sublicense, sell, rent, lease, lend, host, or commercially exploit Torusify except as expressly permitted by these Terms or applicable provider rules;
• reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of Torusify except where applicable law allows this despite the restriction;
• remove, obscure, or alter copyright, trademark, attribution, license, or proprietary notices;
• bypass, disable, tamper with, or interfere with licensing, trial, purchase, entitlement, security, analytics opt-out, or access-control mechanisms;
• use Torusify to violate law, third-party rights, platform rules, or provider terms;
• use Torusify in a way that interferes with, damages, or overloads Rhamosia systems or provider systems.

Trial, Purchases, and Entitlements

Torusify may be offered as a free download, paid download, trial, one-time purchase, subscription, marketplace entitlement, or other license type depending on the version, region, provider, platform rules, or campaign.

Trial length, available features, pricing, promotions, storefront availability, license type, and provider availability may vary by version, region, provider, platform rules, or campaign. Prices shown by the app, website, store, checkout, or provider may change.

For Mac App Store purchases, Torusify relies on StoreKit and Apple’s systems for purchase, restore, entitlement, receipt, refund, and revocation information. If a purchase is refunded, revoked, reversed, charged back, or otherwise invalidated, access to paid features may end.

Entitlement and license checks may be handled by the relevant app store, payment processor, subscription platform, licensing provider, or marketplace. Access may depend on a valid purchase, license, active subscription, account status, device activation, or other provider-managed entitlement.

Refund Policy

Mac App Store

For Mac App Store downloads and In-App Purchases, Apple handles purchases, billing, receipts, taxes, refunds, chargebacks, payment methods, Apple Account records, and refund eligibility.

To request a refund for a Mac App Store purchase, use Apple’s official refund process at https://reportaproblem.apple.com/ or Apple Support.

Rhamosia cannot access your Apple Account, full billing details, payment card information, Apple purchase history, or Apple’s internal refund decision systems. Rhamosia does not decide, promise, approve, deny, or process Apple refunds.

If Torusify does not unlock after purchase, first use the app’s restore purchase flow where available. If restore appears to fail because of an app bug, contact [email protected] with the Torusify version, macOS version, visible error message, and reproduction steps. Do not send Apple ID passwords, payment card numbers, full receipts, or unnecessary billing screenshots.

Other Providers

For purchases, subscriptions, or licenses made through providers other than Apple, refund requests are handled according to the relevant provider’s terms, refund policy, checkout flow, and support process unless Rhamosia clearly states otherwise at the time of purchase.

If a provider acts as merchant of record, reseller, subscription platform, marketplace, or payment processor, that provider may be responsible for billing, taxes, invoices, refund processing, chargebacks, and account-level payment support.

Rhamosia may provide product support and may help investigate app-side defects, but it does not promise refunds outside the rights provided by applicable law, the relevant provider terms, or an explicit written refund policy shown at the time of purchase.

Support and Maintenance

Support requests are accepted through [email protected] and the support information published at https://rhamosia.com/support.

Rhamosia is operated with limited support capacity. Rhamosia may review support messages, bug reports, feedback, legal notices, privacy requests, and security-related notices, but does not guarantee that every message will receive an individual reply or investigation.

Rhamosia may provide updates, bug fixes, compatibility improvements, or feature changes at its discretion. Rhamosia does not guarantee any particular update schedule, compatibility period, feature roadmap, individual support reply, service level agreement, remote support, custom configuration, migration help, troubleshooting outcome, bug fix, feature request, or continued availability of any feature.

Support is generally limited to:

• legal, privacy, and security-related notices;
• reproducible Torusify bug reports;
• published links or FAQ information for official provider processes related to purchases, billing, receipts, refunds, subscriptions, and restore flows;
• minimum contact required for published policies and legal notices.

Bug reports and feature requests may be used as product improvement input. Submitting a bug report or feature request does not create an obligation for Rhamosia to reproduce, fix, prioritize, implement, or individually respond to it.

Rhamosia does not normally provide:

• individual setup consulting;
• remote desktop support;
• display-environment tuning;
• phone or chat support;
• urgent business-continuity support;
• guaranteed replies or response times;
• individual investigation of every report;
• provider account, billing, refund, receipt, or payment-method support handled by Apple or another provider.

Privacy

Torusify and the website are subject to the Rhamosia Privacy Policy at https://rhamosia.com/privacy.

The Privacy Policy explains what Torusify stores locally, what Torusify may send to Rhamosia, what it does not send, how support email is handled, and how provider-managed purchase, billing, refund, license, and diagnostic information may be processed.

Accessibility Permission

Torusify uses the macOS Accessibility permission to provide cursor movement, focused-window, display shortcut, and related visual feedback features.

You are responsible for deciding whether to grant this permission. You can manage the permission in System Settings > Privacy & Security > Accessibility.

Torusify is not intended to collect screen contents, text you type, clipboard contents, file names, window titles, or names of apps you use through the Accessibility permission.

Disclaimers

Torusify is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.

Rhamosia does not warrant that Torusify or the website will be uninterrupted, error-free, secure, compatible with every Mac, display, dock, adapter, driver, third-party utility, macOS version, enterprise policy, accessibility configuration, or future platform change.

Torusify is not designed for safety-critical, emergency, medical, financial, legal, industrial-control, transport, aviation, military, or other high-risk use. You are responsible for deciding whether Torusify is appropriate for your environment and for keeping appropriate fallbacks.

Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, Rhamosia will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, productivity, or work interruption arising from or related to Torusify, the website, these Terms, provider services, purchases, licenses, refunds, or support.

To the maximum extent permitted by applicable law, Rhamosia’s total liability for claims arising from or related to Torusify, the website, these Terms, purchases, licenses, refunds, or support is limited to the amount you paid to Rhamosia or the relevant provider for Torusify during the 12 months before the event giving rise to the claim. If you paid nothing, Rhamosia’s total liability is limited to the minimum amount permitted by applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not allowed by applicable law.

Third-Party Services and Components

Torusify, the website, distribution, purchases, licensing, analytics, support, and diagnostics may depend on third-party platforms, services, SDKs, libraries, or open-source components.

Your use of third-party services may be subject to their own terms and policies. Open-source components remain subject to their applicable open-source licenses.

Intellectual Property

Rhamosia, Torusify, related names, logos, app icons, website content, software, visual assets, and documentation are owned by Rhamosia or its licensors and are protected by intellectual property laws.

These Terms do not grant you any right to use Rhamosia or Torusify names, logos, trademarks, branding, screenshots, videos, or other assets except as necessary to identify Torusify in ordinary personal or internal business use, or where Rhamosia has separately allowed such use.

Changes to Torusify and These Terms

Rhamosia may change Torusify, the website, pricing, trials, promotions, provider availability, features, support scope, and these Terms when needed for product, operational, legal, security, platform, provider, or business reasons.

The effective date at the top of these Terms indicates the latest version. Continued use of Torusify or the website after updated Terms become effective means you accept the updated Terms, to the extent permitted by applicable law.

Termination

You may stop using Torusify at any time. You may delete Torusify from your Mac and manage provider subscriptions, licenses, or purchases through the relevant provider where applicable.

Rhamosia may suspend or terminate your license or access to Torusify if you violate these Terms, violate provider terms, bypass licensing, engage in fraud or abuse, create legal or security risk, or where required by law or provider action.

Termination does not automatically entitle you to a refund. Refunds remain subject to applicable law and the relevant provider’s refund process.

Governing Law

These Terms are governed by the laws of Japan, without regard to conflict-of-laws rules, except where applicable consumer protection law requires otherwise.

Courts in Japan will have jurisdiction over disputes arising from or related to these Terms, Torusify, or the website, except where applicable law gives you mandatory rights to bring claims elsewhere.

プロバイダー規約と優先関係

Torusify の利用には、Torusify を入手または利用するプロバイダーの規約、使用ルール、返金ルール、サブスクリプションルール、支払条件、ライセンス条件、プラットフォームポリシーも適用される場合があります。

これらのプロバイダーには、app store、決済処理事業者、サブスクリプションプラットフォーム、ライセンス管理プロバイダー、marketplace operator、関連する developer tool が含まれる場合があります。

Mac App Store 版では、Rhamosia が App Store Connect で custom EULA を提供しない限り、Apple の App Store terms、Apple Media Services terms、Apple Standard EULA が適用されます。

Torusify をプロバイダー経由で取得、購入、ライセンス、サブスクリプション、または利用する場合、該当プロバイダーの checkout、返金、サブスクリプション、ライセンス、アカウントに関する条件が本規約に加えて適用される場合があります。プロバイダー管理の支払、返金、請求、サブスクリプション、ライセンス、アカウント、プラットフォームアクセスに関して本規約とプロバイダー規約が矛盾する場合、そのプロバイダー管理事項についてはプロバイダー規約が優先されます。

本規約は、適用法により制限できない権利を制限するものではありません。

ライセンス

本規約および適用されるプロバイダー規約に従うことを条件として、Rhamosia は、ユーザーが所有または管理する互換性のある Apple ブランドの macOS デバイス上で、またはプロバイダーの使用ルールにより許可される範囲で、個人利用または社内業務利用のために Torusify をダウンロード、インストール、使用する限定的、非独占的、譲渡不能、取消可能なライセンスを付与します。

Torusify は販売されるものではなく、ライセンスされるものです。明示的に付与されていないすべての権利は Rhamosia またはライセンサーが保持します。

ユーザーは次の行為をしてはなりません。

• 本規約または適用されるプロバイダー規則で明示的に許可される場合を除き、Torusify をコピー、再配布、サブライセンス、販売、賃貸、リース、貸与、ホスト、商業利用すること。
• 適用法により制限できない場合を除き、Torusify をリバースエンジニアリング、逆コンパイル、逆アセンブル、ソースコード抽出の試行、改変、派生物作成すること。
• 著作権、商標、帰属表示、ライセンス、所有権表示を削除、隠蔽、変更すること。
• ライセンス、トライアル、購入、利用権、セキュリティ、analytics opt-out、アクセス制御の仕組みを回避、無効化、改ざん、妨害すること。
• 法令、第三者の権利、プラットフォーム規則、プロバイダー規約に違反する方法で Torusify を使用すること。
• Rhamosia またはプロバイダーのシステムを妨害、損害、過負荷にする方法で使用すること。

トライアル、購入、利用権

Torusify は、バージョン、地域、プロバイダー、プラットフォーム規則、キャンペーンにより、無料ダウンロード、有料ダウンロード、トライアル、買い切り購入、サブスクリプション、marketplace entitlement、その他のライセンス種別として提供される場合があります。

トライアル期間、利用可能な機能、価格、プロモーション、ストアフロントでの提供有無、ライセンス種別、プロバイダーでの提供有無は、バージョン、地域、プロバイダー、プラットフォーム規則、キャンペーンによって変わる場合があります。アプリ、Web サイト、store、checkout、provider に表示される価格は変更される場合があります。

Mac App Store 購入では、Torusify は購入、復元、利用権、領収書、返金、取消情報について StoreKit と Apple のシステムに依存します。購入が返金、取消、差戻し、チャージバック、またはその他の理由で無効化された場合、有料機能へのアクセスは終了する場合があります。

利用権とライセンス確認は、該当する app store、決済処理事業者、サブスクリプションプラットフォーム、ライセンス管理プロバイダー、または marketplace によって扱われる場合があります。アクセスは、有効な購入、ライセンス、有効なサブスクリプション、アカウント状態、デバイス activation、その他のプロバイダー管理の利用権に依存する場合があります。

返金ポリシー

Mac App Store

Mac App Store のダウンロードおよび In-App Purchase について、購入、請求、領収書、税金、返金、チャージバック、支払方法、Apple Account 記録、返金可否は Apple が扱います。

Mac App Store 購入の返金を依頼する場合は、Apple の公式返金手続き https://reportaproblem.apple.com/ または Apple Support を利用してください。

Rhamosia は、ユーザーの Apple Account、完全な請求情報、支払カード情報、Apple 購入履歴、Apple 内部の返金判断システムにアクセスできません。Rhamosia は Apple 返金の判断、約束、承認、拒否、処理を行いません。

購入後に Torusify がアンロックされない場合は、まずアプリ内の購入復元機能がある場合はそれを利用してください。アプリ側の不具合により復元に失敗していると思われる場合は、Torusify version、macOS version、表示されるエラーメッセージ、再現手順を [email protected] へ送ってください。Apple ID のパスワード、支払カード番号、完全な領収書、不要な請求画面のスクリーンショットは送信しないでください。

その他のプロバイダー

Apple 以外のプロバイダーを通じた購入、サブスクリプション、ライセンスについては、購入時に Rhamosia が明示的に別途示す場合を除き、該当プロバイダーの規約、返金ポリシー、checkout flow、サポート手続きに従って返金依頼が扱われます。

プロバイダーが merchant of record、reseller、subscription platform、marketplace、payment processor として機能する場合、そのプロバイダーが請求、税金、invoice、返金処理、chargeback、アカウント単位の支払サポートを担当する場合があります。

Rhamosia は製品サポートを提供し、アプリ側の不具合調査を補助することがありますが、適用法、該当プロバイダー規約、または購入時に明示された書面の返金ポリシーによって与えられる権利を超える返金を約束しません。

サポートとメンテナンス

サポート依頼は [email protected] および https://rhamosia.com/support に公開されるサポート情報を通じて受け付けます。

Rhamosia は限られたサポート体制で運営されています。Rhamosia は、サポートメッセージ、不具合報告、フィードバック、法的通知、プライバシー依頼、セキュリティ関連連絡を確認する場合がありますが、すべてのメッセージに個別返信または個別調査を行うことを保証しません。

Rhamosia は、更新、バグ修正、互換性改善、機能変更を裁量により提供する場合があります。Rhamosia は、特定の更新予定、互換性維持期間、機能 roadmap、個別サポート返信、service level agreement、リモートサポート、カスタム設定、移行支援、トラブルシューティング結果、不具合修正、機能要望対応、機能の継続提供を保証しません。

サポートは通常、次の範囲に限定されます。

• 法務、プライバシー、セキュリティ関連連絡。
• 再現可能な Torusify の不具合報告。

不具合報告と機能要望は、製品改善の入力として扱われる場合があります。不具合報告または機能要望の送信は、Rhamosia が再現、修正、優先対応、実装、または個別返信を行う義務を発生させるものではありません。

Rhamosia は通常、次を提供しません。

• 個別の設定相談。

• 電話またはチャットサポート。
• 緊急の業務継続サポート。

プライバシー

Torusify と Web サイトには、https://rhamosia.com/privacy の Rhamosia Privacy Policy が適用されます。

Privacy Policy は、Torusify がローカルに保存する情報、Rhamosia に送信する可能性がある情報、送信しない情報、サポートメールの扱い、プロバイダー管理の購入、請求、返金、ライセンス、診断情報がどのように処理される場合があるかを説明します。

Accessibility 権限

Torusify は、カーソル移動、フォーカス中ウィンドウ、ディスプレイショートカット、関連する視覚フィードバック機能を提供するために macOS の Accessibility 権限を使用します。

この権限を許可するかどうかはユーザーが判断します。権限は System Settings > Privacy & Security > Accessibility で管理できます。

Torusify は、Accessibility 権限を通じて、画面内容、入力したテキスト、クリップボード内容、ファイル名、ウィンドウタイトル、使用中のアプリ名を収集することを目的としていません。

免責

Torusify は、適用法で認められる最大限の範囲で、「現状有姿」かつ「提供可能な範囲」で提供されます。

Rhamosia は、Torusify または Web サイトが中断なく、エラーなく、安全に、すべての Mac、ディスプレイ、dock、adapter、driver、第三者 utility、macOS version、enterprise policy、accessibility configuration、または将来の platform 変更と互換性をもって動作することを保証しません。

Torusify は、安全上重要な用途、緊急用途、医療、金融、法律、産業制御、交通、航空、軍事、その他の高リスク用途向けには設計されていません。ユーザーは、Torusify が自分の環境に適しているかを判断し、適切な代替手段を維持する責任を負います。

一部の法域では特定の保証否認が認められないため、一部の免責が適用されない場合があります。

責任制限

適用法で認められる最大限の範囲で、Rhamosia は、Torusify、Web サイト、本規約、プロバイダーサービス、購入、ライセンス、返金、サポートに起因または関連する、間接損害、付随的損害、特別損害、結果損害、懲罰的損害、利益、収益、信用、データ、事業機会、生産性、作業中断の損失について責任を負いません。

適用法で認められる最大限の範囲で、Torusify、Web サイト、本規約、購入、ライセンス、返金、サポートに起因または関連する Rhamosia の責任総額は、請求原因となる事象の前12か月間にユーザーが Rhamosia または該当プロバイダーに Torusify について支払った金額を上限とします。ユーザーが何も支払っていない場合、Rhamosia の責任総額は適用法で認められる最小額を上限とします。

本規約は、適用法により除外または制限できない責任を除外または制限するものではありません。

第三者サービスとコンポーネント

Torusify、Web サイト、配布、購入、ライセンス、analytics、サポート、診断は、第三者の platform、service、SDK、library、または open-source component に依存する場合があります。

第三者サービスの利用には、それぞれの規約とポリシーが適用される場合があります。Open-source component には、それぞれの open-source license が適用されます。

知的財産

Rhamosia、Torusify、関連する名称、ロゴ、app icon、Web サイト内容、ソフトウェア、ビジュアル資産、文書は、Rhamosia またはライセンサーが所有し、知的財産法により保護されています。

本規約は、Torusify を通常の個人利用または社内業務利用で識別するために必要な場合、または Rhamosia が別途許可した場合を除き、Rhamosia または Torusify の名称、ロゴ、商標、branding、screenshot、video、その他の資産を使用する権利を付与しません。

Torusify と本規約の変更

Rhamosia は、製品、運用、法務、セキュリティ、プラットフォーム、プロバイダー、または事業上の理由により、Torusify、Web サイト、価格、トライアル、プロモーション、プロバイダー提供状況、機能、サポート範囲、本規約を変更する場合があります。

本規約の冒頭の施行日は最新版を示します。更新後の規約が有効になった後も Torusify または Web サイトを利用し続ける場合、適用法で認められる範囲で、更新後の規約に同意したものとみなされます。

終了

ユーザーはいつでも Torusify の使用を停止できます。Torusify を Mac から削除し、該当する場合はプロバイダーを通じてサブスクリプション、ライセンス、購入を管理できます。

Rhamosia は、ユーザーが本規約に違反した場合、プロバイダー規約に違反した場合、ライセンスを回避した場合、不正または濫用を行った場合、法務またはセキュリティ上のリスクを生じさせた場合、または法令やプロバイダー対応により必要な場合、Torusify のライセンスまたはアクセスを停止または終了することがあります。

終了は自動的な返金権を意味しません。返金は、適用法および該当プロバイダーの返金手続きに従います。

準拠法

本規約は、抵触法の規則を除き、日本法に準拠します。ただし、適用される消費者保護法により別の扱いが必要な場合を除きます。

本規約、Torusify、または Web サイトに起因または関連する紛争については、日本の裁判所が管轄権を有します。ただし、適用法により、ユーザーが他の場所で請求を行う強行的な権利を有する場合を除きます。
